Welcome to Plim Plim Games!

Plim Plim Games provides, through its mobile app (the “App”), a variety of content for children to learn through play (the “Services”). Plim Plim Games is operated by CIRCLES MAGIC LLC, a company in existence and duly set up in accordance with the laws of Delaware, USA, with its registered address at 7950 NW 53rd Street, Suite 337, Miami, Florida 33166, USA.

Please read these Terms of Service (“Terms”) and our Privacy Policy carefully, because they govern your use of the Services. Do not purchase a Subscription or otherwise use the Services if you do not agree with these Terms.

For the purposes of these Terms, users of the Services include Child Users, who are children who use the Services or any of their features, and Adult Users, who are individuals over the age of 18, including parents and guardians of Child Users. We refer to all users collectively as “you”, “your” or “users”.

If you are under the age of 18, you may only use the Services with the consent of your parent or legal guardian, or of a teacher or school administrator authorized to consent on your parent or legal guardian's behalf (an “Adult”). Please make sure an Adult has reviewed and discussed these Terms with you. If you are the parent or guardian of a user under the age of 18, you acknowledge and agree that you have the authority to provide this consent on behalf of that user, that you consent to that user's use of the Services, and that you are responsible for making sure that any child you authorize to use the Services does so in accordance with these Terms.

Content

The content of Plim Plim Games is made available through agreements with producers and distributors, always respecting copyright and intellectual property.

Free Version and Advertising

The App is free to download. The free version includes a selection of games and, on Android, shows contextual, non-personalized advertising, as described in our Privacy Policy. On Android, some games can also be unlocked by watching an advertisement. A Subscription unlocks all available games and removes advertising.

Subscriptions

The App offers optional auto-renewing subscriptions, billed monthly or yearly (a “Subscription”). The price is shown in the App and in the store before you purchase, in your local currency, and is charged to the payment method of your Google Play or Apple App Store account. The App asks for a parental check before any purchase, so that only an Adult can buy a Subscription.

A Subscription renews automatically at the end of each period, at the price then in effect, unless it is cancelled at least 24 hours before the end of the current period. Your account will be charged for the renewal within the 24 hours before the end of the current period.

Free trial. Some Subscriptions may include a free trial. If you do not cancel at least 24 hours before the free trial ends, it converts automatically into a paid Subscription and you will be charged. Where applicable, any unused portion of a free trial is forfeited when you purchase a Subscription.

Payments, taxes, cancellations and refunds are processed by the store from which you purchased the Subscription, and we have limited or no control over them. Please follow that store's instructions for payments (including taxes), cancellations and refunds, and check whether any additional charges apply to your purchase.

You can manage or cancel your Subscription at any time in the settings of the store you purchased it from:

Deleting the App does not cancel a Subscription. If you change devices, an active Subscription is restored when you sign in to the same store account: automatically on Google Play, and from the App's settings on the Apple App Store.

License

Subject to these Terms, CIRCLES MAGIC LLC grants you a limited, personal, non-exclusive, non-transferable and revocable license to download and use the App for your own non-commercial use. You may not copy, modify, distribute, sell or rent the App or its content, or reverse engineer, decompile or attempt to extract its source code, except where applicable law expressly permits it.

Intellectual Property

The Services contain valuable copyrights, trademarks and service marks owned, controlled or used by, or licensed to, CIRCLES MAGIC LLC and its licensors. Any use of these intellectual property rights without the prior written permission of CIRCLES MAGIC LLC is strictly prohibited.

All intellectual property rights, copyrights, trademarks, images, texts, graphics, applications, content, videos and all other material are the sole and exclusive property of KIDS MAGIC LLC. CIRCLES MAGIC LLC is its licensee and is authorized to carry out any development with that intellectual property, copyrights or trademarks.

Links to Other Websites

The Services may contain links to third-party websites or services that are not owned or controlled by CIRCLES MAGIC LLC. The App asks for a parental check before opening any of them. CIRCLES MAGIC LLC has no control over, and assumes no responsibility for, the content, privacy policies or practices of any third-party websites or services. You acknowledge and agree that CIRCLES MAGIC LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance on, any such content, goods or services. We strongly advise you to read the terms and privacy policies of any third-party websites or services that you visit.

Termination

We may suspend or end your access to the Services at any time, without prior notice or liability, if you breach these Terms. You may stop using the Services at any time by deleting the App. Remember to cancel any active Subscription in the store, as described above.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall CIRCLES MAGIC LLC, nor its directors, employees, partners, agents, suppliers or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, resulting from:

  • your access to, use of, or inability to access or use the Services;
  • any conduct or content of any third party on the Services;
  • any content obtained from the Services; and
  • unauthorized access to, use of or alteration of your transmissions or content,

whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Disclaimer

To the maximum extent permitted by applicable law, your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. CIRCLES MAGIC LLC, its subsidiaries, affiliates and licensors do not warrant that:

  • the Services will function uninterrupted, securely or be available at any particular time or location;
  • any errors or defects will be corrected;
  • the Services are free of viruses or other harmful components; or
  • the results of using the Services will meet your requirements.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by contract.

Apple App Store

If you downloaded the App from the Apple App Store, the following terms also apply:

  • These Terms are between you and CIRCLES MAGIC LLC only, and not with Apple Inc. (“Apple”). CIRCLES MAGIC LLC, not Apple, is solely responsible for the App and its content.
  • Your license to use the App is limited to a non-transferable license to use it on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
  • Apple has no obligation whatsoever to provide any maintenance or support services for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
  • CIRCLES MAGIC LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection or similar legislation, and claims that the App infringes a third party's intellectual property rights.
  • You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms of agreement when using the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding the Services and supersede and replace any prior agreements between us regarding the Services.

Changes

We may modify or replace these Terms at any time. Any changes will be posted on this page, and the date at the top of these Terms will be updated. Please check this page periodically. By continuing to use the Services after a change takes effect, you agree to the revised Terms. If you do not agree to them, please stop using the Services and cancel any active Subscription.
